salam alaykum.

i have a friend who is asking me to ask on this forum.

she is none muslim, and married a arabian man who is a muslim and is not practicing.
she is a christian.they have a daughter of 6 and the issue is whether she can ask for a divorce as he is out of control.

he is claiming that a woman cannot ask her husband to divorce her and that she has to pay thousands to a mosque. which they obviously dont have.

there has been physical violence between the two and she has to flea and is living with her sister.
she does not want any contact with him and he is trying his best to keep contact with her to humiliate her etc.

the marriage wasnt inside a mosque was at home address, (at this moment i dont know if they have a nikah certificate) as it was done 20 years ago.

what rights does she have(as a none muslim) and what rights does a husband have?

salam the rule of woman asking for divorce will not apply to her simply because she is a non believer. the husband is stupid to think that the sharia rules apply to his wife. the wife should go and see a alim in islam and talk to him and if he agrees then the divorce will take place regardless of what the husband wants. the second option will be to approach the courts and get rid of this man through that system. its good to see the his wife is concerned about this, may allah azwajall guide her to deen e haaq. ameen
